- ELIGIBLITY: Jones Soda Co.’s Youth Advisory Board (JYAB) Application Program (the “Program”) is open to individuals who are 14-24 years of age, currently enrolled in an academic school program (middle school, high school, technical school, or college/university), involved in at least one (1) extra curricular activity, and are legal residents of the 50 United States, the District of Columbia or Canada.
- HOW TO APPLY: Between May 1, 2007 and June 30, 2007, complete the online application and upload your video essay (60 seconds or less) at our online submission page. All submissions must be received electronically. No applications will be accepted via standard mail. Limit one (1) application per person for the 2007-2008 application period.
- VIDEO APPLICATION CRITERIA: Entrants are to submit a video in (60 seconds or less) explaining how you would make the ultimate Jones Youth Advisory Board (JYAB) member. Videos longer than 60 seconds in length will be disqualified.
Please title videos in the following format: First name Last name, State abbreviation (example: Mike Jones, WA). The file size must be under 5meg. We only accept the following video formats: MPG, MPEG, AVI, MOV, FLV.
Each video submission must be entrant’s own original work and may not be offensive, as determined by JONES Soda in its sole discretion, nor can it defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights.
- SELECTION: This is an application process for the JYAB. All entries will be reviewed by employees of Jones Soda Co. Final decision will be made by Peter van Stolk, President and CEO. ALL DECISIONS ARE FINAL.
Members will be selected based on experience, qualifications for the program, originality, and creativity.
THE PROGRAM: Jones Soda will select 7 members for the 2007-2008 Jones Soda Youth Advisory Board (JYAB). Members will serve as
advisors to the
Jones Soda Board of Directors, providing insight into the marketing and consumer outreach practices of Jones Soda Co.
Appointed Board Members will serve for a 1-year term with the option to reapply for a second 1-year term. Members may serve a maximum of 2 years on the board. Participants will receive up-to a $1,000 scholarship for each term served. Individual scholarship awards will be determined by the number of meetings participated in during the 2007-2008 year.
- PARTICIPATION AND DUTIES: Selected members will participate in a total of 12 JYAB meetings. The meetings include four (4) quarterly meetings to be held in Seattle, WA and eight (8) teleconferences (in months quarterly meetings are not scheduled).
Monthly meetings will be conducted on the second Tuesday of every month at 4:00pm PDT. A toll-free conference number will be provided. Members within a close proximity to the Seattle office are invited to join onsite. Should a member elect on-site participation, they will be reimbursed mileage expenses. Monthly meetings will not take place in months that quarterly meetings are scheduled.

Quarterly on-site meetings will be held in Seattle, WA and are REQUIRED events. Members who fail to attend on-site meetings may be subject to termination. On-Site meetings are scheduled as follows (subject to change):

Flexibility due to extra curricular activities: Jones Soda requires JYAB members to be actively involved in their schools and communities, thus we recognize the possibilities that conflicts may occur. Absences must be approved 3 weeks prior to the monthly meeting. Each member is allowed 1 unexcused absence per term without penalty.
- TRAVEL AND ACCOMODATIONS: Jones Soda Co. will be responsible for all travel expenses including flight, hotel accommodations, food and on-site entertainment for each member of the JYAB.
Travel, accommodations and per-diem food for one (1) parent/guardian will also be provided by Jones Soda Co. for minors under the age of 18 for each on-site meeting. Parents/Guardians WILL NOT participate in JYAB meetings; however, are invited to participate in all group entertainment.
- NOTIFICATION: Only chosen participants will be notified of their submission and selection. Selected participants will be contacted by phone and/or email on or before July 17, 2007. Upon accepting membership to the Jones Youth Advisory Board, participants may be required to sign a Jones Soda Code of Conduct, confidentiality agreement, parental/guardian authorization and release form, model release form for video production and/or other miscellaneous forms associated with their membership.
- PUBLICATION OF MEMBERS: After acceptance of 2007-2008 JYAB members, participants will be published online at www.jonessoda.com. A list of winners may also be received by sending a self-addressed, stamped envelope to Jones Soda Co., 234 9th Avenue North, Seattle, WA 98109 buy August 31, 2007.
- OWNERSHIP / PUBLICITY: Applications and video submissions become the sole property of Jones Soda Co. and will not be return to the entrant. Jones Soda Co. reserves the right to use submitted property for promotional and marketing purposes. Entrants will be contacted directly should their work be used by Jones Soda Co. Except where prohibited by law, each chosen participant’s submission constitutes permission for Jones Soda Co. and its affiliates to use his or her name, photograph, likeness, statements, biographical information, voice and address (city and state only) worldwide and in all forms of media, in perpetuity, without further compensation.
- DISCLAIMER: Jones Soda Co. is not responsible for late, lost, damaged, misdirected, incorrectly addressed, incomplete, illegible, undeliverable or destroyed on-line application and video submissions resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer transmissions, typographical or system errors and failures or faulty transmissions or for any problems or technical malfunction of any telephone network or lines, computer online systems, services or providers, computer equipment, or for applications not received by Jones Soda Co. on the account of technical problems or traffic congestion on the Internet, including any injury or damage to applicant’s personal computer related to or resulting from entering the JYAB or downloading any materials for the JYAB, or other telecommunications malfunctions which may limit an applicant’s ability to participate. Jones Soda Co. and its affiliates, officers, directors, agents and employees will have no liability or responsibility for any claim arising in connection with participation in the JYAB Program.
CAUTION: Any attempt by an applicant to deliberately damage any Website or undermine the legitimate operation of the JYAB Program may be a violation of criminal and civil laws. Should an attempt be made, Jones Soda Co. reserves the right to disqualify such applicant and seek damages from any such applicant to the fullest extent permitted by law.
- RELEASE: By entering the JYAB Program, the applicant agrees to release and hold harmless Jones Soda Co., and its affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the JYAB Program.
- GOVERNING LAW: The JYAB Program shall be governed by the laws of the United States and the State of Washington.
- PRIVACY: Information collected through the JYAB Program is subject to the Jones Soda Co.’s Privacy Policy http://www.jonessoda.com/files/privacy.php.
- BINDING ARBITRATION: By entering the JYAB Program, the applicant agrees that any and all claims against Jones Soda Co., its affiliates, employees, officers, directors, judges and agents, arising out of this Program shall be settled by final and binding arbitration in King County, Washington before the American Arbitration Association pursuant to the United States Arbitration Act, 9 U.S.C. §1-16, or before the American Arbitration Association under its International Arbitration Rules if the claim arises from conduct outside of the United States. Any such claim must be filed with the American Arbitration Association within one year after the date that the overall winners have been notified by mail, or no claim or action may be sustained against Jones Soda Co., its affiliates, employees, officers, directors, judges and agents, arising out of this Program.
